The DSA in Italy: AGCOM, double anonymity and your report route

In Italy, AGCOM (Autorità per le Garanzie nelle Comunicazioni) is the Digital Services Coordinator for the EU Digital Services Act. AGCOM also wrote Italy’s age-verification rules for adult sites, built on “double anonymity”. That makes AGCOM the authority to plan for twice: once for how people report content, once for how adults get in.

In short
  • AGCOM is Italy’s Digital Services Coordinator: it supervises providers established in Italy, handles complaints and can impose fines.
  • AGCOM’s delibera 96/25/CONS separately sets age verification by double anonymity for adult sites reachable from Italy.
  • Italian upload sites need a report form (Art. 16), statements of reasons (Art. 17), contact points (Art. 11 and 12) and terms with content rules (Art. 14).
  • Double anonymity protects visitors’ identity at the gate. Your report route should not undo that by forcing a login.

Does this apply to your site?

Two sets of rules from one authority. Here’s how to tell which ones reach you.

What regulators expect

  1. Set up a certified double-anonymity check. An independent third party confirms that the visitor is an adult; your site gets the answer, not the identity. Our Italian age-check page has the details.
  2. Offer “Segnala un contenuto” in Italian. URL, reason, name and email and a good-faith statement, reachable without logging in or passing the gate.
  3. Name the DSA contacts on your legal page. An authority contact with languages, for example Italian and English, and a user contact a person answers.
  4. Explain removals in Italian. Tell uploaders and performers what you did, why, and how to complain.
  5. Add content rules to your terms. What isn’t allowed, how you moderate, and the complaint route, in plain Italian.

AGCOM supervises DSA duties for providers established in Italy only. The age-verification rules are a separate AGCOM decision that reaches adult sites accessible from Italy.

How No451 checks your site

We read your legal, terms and contact pages from an Italian connection and look for the DSA contact points, content-rules topics and a report form with the Art. 16 elements. The double-anonymity gate is checked separately with our age-check checks.

We don’t have a stored real DSA result yet, so this is a real finding from our age-check checks: behind an age-check overlay, 6 images were already on the page, 5 blurred and 1 not blurred at all.

The fix: send a page with only the check until the visitor passes. DSA findings look the same: what we saw, the evidence and the fix.

Common mistakes

Enforcement

AGCOM supervises DSA duties for providers established in Italy, handles complaints and can impose fines. Its age-verification rules are enforced separately under AGCOM’s own procedure for listed operators (formal notice with 20 days to comply, then possible blocking; Delibera 96/25/CONS).

Questions operators ask

Who supervises the DSA in Italy?

AGCOM, as Italy’s Digital Services Coordinator, for providers established in Italy. Very large platforms are supervised by the European Commission.

Is double anonymity a DSA rule?

No. It comes from AGCOM’s delibera 96/25/CONS on age verification. The DSA’s minors guidelines point the same way, recommending real age verification for porn.

Should people log in to report content?

No. A report form anyone can use without an account fits both the DSA and double anonymity.

Which language should the report form use?

Italian, ideally with English too. The DSA doesn’t name a language, but your users and AGCOM will expect Italian.
