Texas: age-verification law for adult sites

Summary of the official sources · checked 19 October 2026 · Not legal advice.

Texas Civil Practice and Remedies Code chapter 129B (HB 1181) requires reasonable age verification on websites more than one-third of which is sexual material harmful to minors, effective 1 Sep 2023. Accepted methods are digital identification, government-issued ID, or a commercial system using transactional data; identifying information may not be kept. HB 581 added the same duty for public tools that create artificial sexual material, from 1 Sep 2025. The Supreme Court upheld the age-verification duty in Free Speech Coalition v. Paxton (27 Jun 2025). The health-warning notices in §129B.004 are still in the statute, but a court order bars their enforcement while the case continues.
