Age checks in Germany: what the JMStV means for adult sites
In Germany, porn may only be offered online inside a closed user group that makes sure only adults get in. The KJM sets what such a system has to do. In practice that is much stricter than a pop-up: it means identifying the person once and checking them again every time they come back.

- Porn is only allowed online inside a closed user group (geschlossene Benutzergruppe) that ensures only adults have access (JMStV § 4 Abs. 2).
- The KJM sets the requirements for these systems and assesses age-verification systems.
- The usual model has two stages: identify the person once, then authenticate them each time they use the site.
- A date-of-birth box, a “Yes, I’m 18” button or a disclaimer is not a closed user group.

What regulators expect
- Choose an age-verification system the KJM has assessed. The KJM publishes its criteria and the systems it has looked at. Ask a provider which assessment covers their product.
- Identify once, authenticate every visit. The first stage establishes that the person is an adult; the second makes sure it is the same person each time, for example with a login.
- Put every explicit page and file behind the group. Media URLs, sitemaps and preview images must not open the content to visitors outside it.
- Keep a public front with neutral content only. Your start page can explain the offer and lead to sign-up, without explicit pictures.

We scan your site from a German connection the way a first-time visitor sees it. We note what kind of gate appears, what is already on the page behind it, and whether media files answer without passing it. We only ask for file headers, never the files themselves.

Common mistakes
- Treating an age pop-up as a closed user group. A pop-up asks; a closed user group identifies and authenticates.
- Blurred previews on the start page. The pictures are already loaded; blur is a CSS effect anyone can switch off.
- Verified once, open forever. Without the second stage, a shared link or cookie lets anyone in.
- Forgetting the media server or CDN. Files often open directly, even when the pages are locked.
Enforcement
The KJM supervises these rules through the state media authorities (Landesmedienanstalten). Offering pornography online outside a closed user group can be fined as an administrative offence (JMStV § 24).
Questions operators ask
Is a date-of-birth check enough in Germany?
No. Entering a date doesn’t identify anyone. The JMStV asks for a closed user group, and the KJM sets what such a system must do.
Does this apply if my site is hosted outside Germany?
The rule is about content offered to people in Germany. If German visitors can open your explicit content, plan for it.
Is facial age estimation enough for Germany?
That depends on the KJM’s assessment of the specific system and how it is used. Ask the provider for the KJM assessment that covers their product and the way you plan to use it.
